Kearney Man Arrested for Felony Domestic Assault, Records Show Three Prior Domestic Convictions

Kearney, NE -- On Wednesday, May 26, 2021, an officer from the Kearney Police Department was dispatched to the Law Enforcement Center to meet with a female victim regarding an assault that had occurred earlier that morning.

When the officer met with the victim, she stated that her significant other, Cole Malone, had "returned home from work angry and grabbed her neck tightly with his right hand." The officer was able to obtain photographs of red marks on the front and sides of the victim's neck. The victim also told the officer that Malone put his left hand on her head and held his forehead against hers while screaming at her.


Police say that contact was made with Malone at his residence, where he stated that behavior had escalated toward the victim, but denied assaulting her.


According to Nebraska Court Records, Malone has been in the State prison system three separate times for charges including, but not limited to: 3rd Degree Domestic Assault, Motor Vehicle Homicide, Terroristic Threats, Violation of Protection Order, and Theft by Unlawful Taking.


According to court records, Malone has convictions for 3rd Degree Domestic Assault in 2011 and twice in 2017.


If convicted on the 3rd Degree Domestic Assault Charge (Prior Offense), a Class IIIA Felony, Malone faces a possible maximum of three years imprisonment, a $10,000 fine, or both. There is no minimum sentencing for this charge.


Malone has is free on bond at this time after posting $5,000 Cash. A no-contact order was put in place when Malone posted the bond.
